Government must repay millions
On 25 October 2010 Mr Packington SM dismissed a charge of failing to vote at the daylight referendum in 2009, and in so doing exposed a major flaw in the government's revenue raising activities.
Jeremy London of Macdonald Rudder successfully argued that the procedure used to register penalty notices with the Fines Enforcement Registry did not comply with the prescribed procedure. This means that all penalty notices (fines) registered with the Fines Enforcement Registry following the same procedure are invalid. Anyone who paid a fine is entitled to a refund.
It is known that for the daylight referendum alone, about 20,000 fines were registered using the invalid procedure.
